By accessing and using Fetchly ("the Service"), you accept and agree to be bound by the terms and provision of this agreement.

If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Fetchly provides a multi-store delivery platform that allows customers to order items from multiple stores in a single order and have them delivered by a single driver.

The Service includes mobile applications for customers and drivers, a web portal for store owners, and associated technologies.

3. User Accounts

You must create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for all activities that occur under your account.

4. Orders and Payments

All orders placed through the Service are subject to acceptance by the relevant stores and availability of drivers.

Prices are set by individual stores and may change without notice. Delivery fees are calculated based on distance and number of stops.

Payment is processed securely through Stripe. By placing an order, you authorize us to charge your payment method for the total amount.

Payment buffers may be held to account for potential item substitutions or unavailability.

5. Delivery

We aim to deliver orders within the estimated time frame, but delivery times are estimates and not guaranteed.

Drivers will attempt delivery at the address provided. If you are not available, the driver may leave items in a safe location or return them to the store.

Temperature-sensitive items are delivered following optimized routes to maintain product quality.

6. Cancellations and Refunds

Orders can be cancelled before a driver is assigned. Once a driver is assigned, cancellation may result in a cancellation fee.

Refunds for cancelled orders are processed to the original payment method within 5-10 business days.

If items are unavailable, we will notify you and offer substitutions or refunds for those items.

7. Prohibited Uses

You may not use the Service for any illegal or unauthorized purpose.

You must not transmit any worms, viruses, or any code of a destructive nature.

You may not violate any laws in your jurisdiction when using the Service.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Fetchly and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.

9. Limitation of Liability

Fetchly shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

Our total liability for any claims under these terms is limited to the amount you paid us in the 12 months before the claim arose.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the Service.

Your continued use of the Service after changes are posted constitutes acceptance of the modified terms.
